Welcome to Print Peppermint, operated by Austin Terrill DBA Print Peppermint ("Print Peppermint," "we," "us," or "our"). By using our website at printpeppermint.com and placing an order, you agree to these Terms of Service and our Privacy Policy (collectively, the "Policies"). If you do not agree, please do not use our website.
We may update these Terms from time to time. Continued use of the site after changes constitutes acceptance. We encourage you to review this page periodically.

1. Definitions
"Buyer" or "you" means the person placing an order through our website. "Goods" means the printed products or services purchased. "Order" means a Buyer's submitted order for Goods. "Order Confirmation" means our written confirmation of your Order. "Contract" means the Order together with the Order Confirmation and these Terms. "Price" means the total amount payable including applicable shipping, as displayed at the time of Order. "Special Conditions" means any additional conditions specified in the Order Confirmation. "Writing" includes email clearly identifying the sender and recipient.
2. Basis of Sale
These Terms, together with any Special Conditions, constitute the entire agreement between you and Print Peppermint regarding the purchase of Goods. Any terms in your purchase order or other documents that conflict with these Terms are expressly excluded. Variations to these Terms are only binding if agreed in writing between authorized representatives. Our staff are not authorized to make representations about the Goods unless confirmed by us in writing.
3. Orders and Specifications
All products are offered subject to availability. We reserve the right to decline any order without providing a reason. We will confirm accepted orders in writing via Order Confirmation.
We pursue continuous product improvement and may modify product specifications without prior notice. Due to inherent differences between screen-based color systems (RGB) and print color systems (CMYK/PMS), delivered products may vary slightly in color from what appears on your screen. We strive for accuracy but cannot guarantee exact color matches between your monitor and the final printed product.
4. Price, Payment, and Taxes
You are responsible for all applicable taxes on your order, including sales tax and any taxes in the delivery jurisdiction. Payment is required at the time of placing your Order via credit card, debit card, or PayPal, processed through our payment provider (Stripe). Payment in full is taken when the Order is placed, and the Contract is formed upon successful payment.
You confirm that all information provided is accurate, that the payment method used belongs to you or that you are authorized to use it, and that sufficient funds are available. We reserve the right to validate payment details before accepting your Order.
5. Design Proof and Approval
For most orders, we provide a free digital proof (PDF) for your review and approval before production begins. It is your responsibility to carefully review the proof for accuracy, including spelling, layout, colors, and specifications. Once you approve a proof, we are not liable for errors that were present in the approved proof. If you request changes after approval, additional fees or production delays may apply.
6. Production and Delivery
We will endeavor to produce and ship your order within the timeframe stated for each product. Production times are estimates and not guaranteed. We reserve the right to ship items separately or combine shipments.
Delivery dates are estimates only. We are not liable for any loss or expense arising from delivery delays. Upon delivery, you should inspect the Goods promptly. Signing a carrier's delivery confirmation constitutes acknowledgment of receipt in the quantity indicated and in apparent good condition.
If Goods arrive damaged or defective, notify us within 14 days of delivery as described in Section 8.
7. Risk and Property
Risk of damage or loss passes to you upon delivery to our chosen carrier. Ownership of the Goods does not transfer to you until we have received full payment.
8. The Peppermint Promise — If you're not happy, we reprint
8.1 If you're not happy with how your order was printed (colour, foil, finish, trim, impression, or damage in transit), tell us within 14 days of delivery, with your order number and a photo, and we'll reprint it at no charge.
8.2 A reprint is our remedy. We'll keep making it right until it is right. If we can't (for example, a material is no longer available), we'll refund the affected items.
8.3 Your approved proof is the blueprint. Changes to the design, wording or specification after you approved the proof are a new order; we'll offer it at a reprint discount. Because all Goods are custom-made to your specifications, we don't accept returns or offer refunds for buyer's remorse or for errors present in artwork you approved.
8.4 You may cancel an Order (a) if we have not delivered the Goods within 60 days of the Order date, or (b) if a reprint under 8.2 cannot fix a defect.
8.5 Nothing in these Terms limits rights you have by law that can't be limited.

9. Limitation of Liability
We will not be liable for defective or short-delivered Goods unless you notify us in accordance with Section 8. For valid claims, our remedy is a reprint under Section 8; where a reprint cannot fix the problem, we will refund the Price (or an appropriate portion).
We are not liable for losses caused by events outside our reasonable control, including but not limited to strikes, power failures, natural disasters, pandemics, shipping carrier delays, or government actions.
Our total aggregate liability arising from any Contract shall not exceed the Price you paid for the Goods in question. We are not liable for loss of profits, revenue, or any indirect, incidental, or consequential damages.
THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "WITH ALL FAULTS." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THESE EXCLUSIONS MAY NOT APPLY TO YOU.
10. Intellectual Property
All content on printpeppermint.com — including text, graphics, logos, images, software, and design — is owned by Print Peppermint or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any content from this website without our prior written permission.
The Print Peppermint name, logo, and asterisk mark are trademarks of Austin Terrill DBA Print Peppermint. These may not be used in connection with any product or service not ours, or in any way that disparages or discredits us.
By uploading artwork, fonts, images, or other materials to our website, you represent and warrant that you own or have the legal right to use those materials and that they do not infringe any third party's intellectual property rights. You are solely responsible for any claims arising from your uploaded content. We reserve the right to refuse or remove any material we believe infringes third-party rights.
11. DMCA Copyright Complaints
Print Peppermint is a "service provider" under the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been reproduced on our website in a way that constitutes infringement, please send a notice to [email protected] including: (a) your signature (electronic or physical); (b) a description of the copyrighted work and its location on our site; (c) your contact information; (d) a good-faith statement that the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized agent.
12. Data Protection and Privacy
We process personal data in accordance with our Privacy Policy. We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable to EU/EEA residents, and applicable US state privacy laws including the California Consumer Privacy Act (CCPA) where applicable.

13. Account Registration
To place an order, you may be required to create an account. You represent that you are at least 18 years old and that all information you provide is accurate. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at our discretion for violation of these Terms or for any conduct we deem harmful to our business or other users.
14. User Content and Materials
We reserve the right to reject any artwork, images, or content that we determine, in our sole discretion, to be obscene, offensive, defamatory, infringing, or otherwise inappropriate. We are not obligated to print materials that violate applicable laws or these Terms.
15. Indemnification
You agree to indemnify and hold harmless Print Peppermint, its owner, employees, agents, and service providers from any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising from: (a) your use of the website; (b) your uploaded content or artwork; (c) your breach of these Terms; or (d) your violation of any law or third-party rights.

Our website may contain links to third-party websites. We do not endorse or assume responsibility for the content, privacy practices, or security of any third-party sites. You access them at your own risk.
17. Website Availability
We strive to keep our website available at all times but cannot guarantee uninterrupted access. We are not liable for any downtime, interruptions, or technical issues.
18. Typographical Errors
We make every effort to ensure the accuracy of product descriptions and pricing on our website, but errors may occur. We reserve the right to correct any errors and to cancel or modify orders placed based on incorrect information.
19. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Michigan, United States. Any disputes arising from or relating to these Terms or your use of the website shall be subject to the exclusive jurisdiction of the state and federal courts located in Wayne County, Michigan.
20. Severability
If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
